JULY 20, 2020 COVID-19 WAIVER OF LIABILITY
AND HOLD HARMLESS AGREEMENT


In consideration for being able to attend the Getting A New Production Well- Start to Finish Workshop, I hereby acknowledge, agree, and represent as follows:

I am aware of the novel coronavirus ("COVID-19") worldwide pandemic and that the Centers for Disease Control and Prevention ("CDC") considers COVID-19 to be highly contagious and spread mainly from person-to-person through respiratory droplets produced when an infected person coughs or sneezes. I am aware that millions of COVID-19 infections have been confirmed throughout the United States, including several thousands of cases in Indiana and surrounding states. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.

I fully understand and appreciate both the known and unknown dangers of utilizing the facilities and services of the Indiana Section American Water Works Association ("INAWWA") at the Getting A New Production Well- Start to Finish Workshop and acknowledge that my use thereof may, despite the INAWWA's reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.

I hereby RELEASE, WAIVE, DISCHARGE, INDEMNIFY, HOLD HARMLESS AND COVENANT NOT TO SUE the INAWWA, its directors, officers, employees, volunteers, and agents from and against any and all liability to the undersigned and all personal representatives, assigns, heirs, and next of kin of the undersigned for any loss or damage, and any claim or demand on account of any property damage or any injury to, or any illness or death of, the undersigned, including without limitation, as a result of exposure to or infection with COVID-19, whether caused by the negligence, active or passive, of the INAWWA or otherwise while the undersigned is participating in the Getting A New Production Well- Start to Finish Workshop.

I AM AWARE THAT BY AGREEING TO THIS AGREEMENT I AM GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES FROM THE INAWWA.
